Well, I'm no lawyer either, but it looks to me like the caveats to the blanket policy allow plenty of wiggle room for the White House policy. "Other persons may have rights" could be construed to mean Pete Souza and other members of the staff. Souza has worked previously as the official White House photographer (during the Reagan years), and he has published several books from that time. I'd be surprised if this wording isn't precisely this way in order for a photographer to retain partial right to his or her work. I know former White House photographer Barb Kinney (Clinton era) and can pursue the question if you're interested.

It might be possible that photographers working for that office -- even the person deemed the "official" shooter -- are contractors. Barb would obviously know the answer to that one, too.

And "Not all work that appears on US Goverment Websites is considered to be a US Government work" presumably was intended to mean that outside images appearing on a government site shouldn't be construed as government images. That said, a White House lawyer might argue that the caveat means whatever he or she -- or the president -- wants it to mean.

This may also simply be one very small aspect of the overall push for greater executive privilege that began under Bush and has continued under Obama ...

This is an interesting topic. Did you hear about the recent Bush billboard? http://politicalticker.blogs.cnn.com/2010/02/09/mystery-bush-sign-causes-stir/?fbid=C-wji2B9nE0&hpt=T2

I wonder if they can demand that this be taken down as well. I guess one obvious difference is that the Bush billboard is not an ad but a political statement.
